Almost all claims issued at Court on or after 1 October 2023 for disputes of up to £100,000 will be subject to new procedural rules. The successful party’s entitlement to recover its legal costs from the losing party will be limited to the fees prescribed in the new rules.
If you are in dispute (or can see one on the horizon) this rule change is will impact the commercial considerations of how you chose to deal with that dispute.
With a complex new rule structure, the strategic route to maximising outcome cannot be underestimated.
You should act now to get clear advice on how the rule change will impact your exposure to the other side’s costs and what you might be able to recover if you are successful.
